2. Scope

These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by the micro-enterprise PURE OPTION CBD with customers wishing to purchase the products offered for sale on the website. https://pureoptioncbd.fr .

Any order implies unreserved acceptance of these terms and conditions by the customer.

These General Terms and Conditions of Sale are accessible at any time on this website and shall prevail, where applicable, over any other version or any other contradictory document.

Product offers are subject to availability. Information on product availability is provided at the time of placing an order.

Changes to these General Terms and Conditions of Sale are enforceable against users of the website www.pureoptioncbd.fr from the time they are posted online and cannot apply to transactions concluded previously.

3. Products

All products sold on pureoptioncbd.fr comply with current French and European legislation, particularly regarding THC content (<0.31%), and certificates of analysis confirming legal compliance are available. The products are intended for vaporisation (not combustion) or collection. Our products are derived from hemp varieties listed in the European catalogue, in accordance with European Standard 1308/2013 of 17 December 2013.

The products offered are not medicines and are in no way a substitute for medical treatment.

Warning: products prohibited for minors, not recommended for pregnant or breastfeeding women and people undergoing medical treatment without medical advice.

4. Price

Prices are shown in Euros, inclusive of VAT, excluding delivery charges.

PURE OPTION CBD reserves the right to change its prices at any time, but products will be charged based on the rates in effect at the time the order is confirmed. Prices are shown in euros inclusive of all taxes, excluding delivery charges.
An invoice will be provided upon delivery of the order.

5. Order

The customer must be at least 18 years old to place an order.

The validation of an order constitutes acceptance of the prices and descriptions of the products.

PURE OPTION CBD reserves the right to refuse or cancel any order from a customer with whom there is a dispute.

When placing your first order on the website www.pureoptioncbd.fr, you will need to complete a customer account form.

The information requested from you is that which is necessary to draw up your invoice and to be able to deliver your order to your home or to any other address of your choice.

Your basket's product selection:

You select the products to put in your basket with a simple click.

After selection, the price including tax for the products in your basket will be displayed along with the delivery cost.

After reading and accepting these General Terms and Conditions of Sale, you validate your order by clicking on the button: «order» or «validate».

The sale will only be considered final after the Seller has sent the Buyer confirmation of order acceptance by email and after the Seller has received the full payment (including shipping costs).

6. Payment

Payments are secure and accepted by credit card (Visa, Mastercard) and bank transfer.

The order is considered final after the payment has been effectively received.

Payments made on the website www.pureoptioncbd.fr are secured by the system Stripe.

Therefore, the Buyer's bank details (credit card number and expiry date) are encrypted and then processed by our financial partner.

In the event of non-compliance with the payment terms set out above, we reserve the right to suspend or cancel the delivery of current orders placed by the Buyer, without prejudice to damages.

7. Delivery

Deliveries are handled by La Poste.

Average delivery times: 48 to 72 working hours in mainland France.

Delivery possible throughout the European Union and Switzerland (delivery times vary).

Delivery charges and times are shown during the checkout process.

Delivery shall be deemed to have been effected upon the handover by the Seller of the ordered products to the carrier.

The Buyer is required to check the condition and conformity of the delivered products. The Buyer has a period of two (2) days from the date of delivery to record any reservations, along with all supporting documents. After this period, and in the absence of these formalities having been met, the products shall be deemed to be compliant and free from any apparent defects, and no claim shall be validly accepted by the Seller.

8. Transfer of ownership – transfer of risk

Ownership of the Seller's products shall not transfer to the Buyer until the price has been paid in full by the Buyer, regardless of the delivery date of the said products.

However, the transfer of the risks of loss and deterioration of the products will take place from the moment the ordered products are handed over to the carrier for delivery to the Buyer.

From the point of delivery, the risks relating to the products are transferred to the customer.

9. Right of withdrawal

In accordance with Article L221-18 of the Consumer Code and Article L121-21 of the Consumer Code, and within the framework of distance selling, the customer has a period of fourteen (14) calendar days from receipt of their order to exercise their right of withdrawal, without having to provide any justification.

To exercise this right, the customer may use any of the following means:

Once the withdrawal is registered via the «Confirm withdrawal» button, the customer immediately receives an acknowledgement of receipt by email on sustainable support, mentioning the date and time of the declaration as well as a reference number.

The return must be made in the original packaging and in perfect condition.

Exceptions: opened, unsealed, or consumable items (flowers, resins, e-liquids, cosmetics) cannot be returned for reasons of hygiene and safety.

The return of products must be accompanied by the invoice.

The exchange (subject to availability) or refund will be processed within a maximum of fourteen (14) days from the Seller's receipt of the items returned by the Buyer.

Return costs remain the responsibility of the customer.

10. Statutory warranty

All products benefit from the legal guarantees of conformity (articles L217-4 et seq. of the French Consumer Code) and against hidden defects (articles 1641 et seq. of the French Civil Code).
In the event of a defect being found, the customer may request a replacement or refund of the product.

Our products comply with current French regulations. We cannot be held liable for failure to comply with the legislation of a country other than France where the products are delivered, and it is the Buyer's responsibility to verify this.

The photographs and illustrations accompanying the products on the Website are not contractual. They are taken from the manufacturers/producers and therefore cannot engage our responsibility.

The Buyer is solely responsible for the choice, storage, and use of the products. 

We shall not be considered liable, nor in default, for any delay or non-performance resulting from the occurrence of a force majeure event. Within the scope of these terms, force majeure events shall include, in addition to those recognised by the case law of the French Court of Cassation, all natural disasters, all acts of war, breaches of public order, epidemics, fires, floods and other disasters, all governmental acts, all strikes, lockouts, including those of our staff or that of our usual carriers, any breakdown in the supply from our own suppliers, as well as all external electrical and technical problems beyond the parties' control preventing communications as defined by Article 1218 of the Civil Code (strikes, natural disasters, pandemics, fires, floods, internet outages, etc.).

Furthermore, in the online sales process, our liability cannot be engaged for damage resulting from the use of the internet network, such as, but not limited to: data loss, intrusion, viruses, service interruptions, unsolicited messages from third parties.

11. Data Protection

In accordance with Law 78-17 of 6 January 1978, it is reminded that the personal data requested from the Buyer are necessary for the processing of their order, the delivery of the ordered products, and the preparation of invoices and warranty contracts.

Personal data is processed in accordance with the General Data Protection Regulation (GDPR). For more details, please consult our Personal Data Protection Policy.

The Buyer has, in accordance with current national and European regulations, a permanent right of access, modification, rectification and objection concerning information relating to them.

12. Intellectual property

The content of the site is the property of PURE OPTION CBD and its partners and is protected by French and international intellectual property laws.

Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright. 

13. Governing law and disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, an amicable resolution shall be sought between the buyer and PURE OPTION CBD before any mediation or legal action.

In accordance with the provisions of the Consumer Code concerning «the consumer dispute mediation process», after contacting us and in the absence of a satisfactory response, you have the option to use the consumer dispute mediation service free of charge from:

In the absence of an agreement, the competent courts shall be those of the district of the registered office of PURE OPTION CBD, unless otherwise required by mandatory legal provisions.

14. Acceptance by the Purchaser

A natural person (or legal entity) ordering on the website www.puroptioncbd.fr acceptance and full and complete acceptance of these General Conditions of Sale, which is expressly acknowledged by the Buyer, who waives, in particular, the right to rely on any contradictory document, which would not be enforceable against the Seller.
